Naavi.org is a community interested in the emerging field of laws governing the Cyber Society. The goal of Naavi.org is to contribute towards building a Responsible Cyber Society.

The prime mover of this concept is Na.Vijayashankar, better known as Naavi. He is an Information Assurance Consultant and presently works from Bangalore, India. He has a rich professional experience spanningnearly 4 decades in the fields of Banking, Financial Services, Advertising and Marketing besides Cyber Law and Education.

Naavi.org is a mirror site of Naavi.com (Now being cyber squatted) which was first established in 1998. Since December 1999, it was developed into a portal on Cyber Laws. Today it is the premier Cyber Law information portal in India.

www.cyberlawcollege.com, www.arbitration.in, www.lookalikes.in, and www.ceac.in, information-assurance.in are a few other related sites run by Naavi.

Cyber Law College has been a pioneer in Cyber Law Education in the Country with the introduction of online courses since 2000. It is a pioneer in offline education in Cyber Laws in Karnataka where it is conducting offline courses in several places in association with several law colleges.

Naavi has also been in the forefront of Netizen movement in India. He is the founder secretary of Cyber Society of India, Founder Trustee of International Institute of Information Technology Law, and Founder Chairman of Digital Society Foundation.

Naavi is a visiting Faculty in a number of educational institutions and provides consultancy to several companies.

Naavi as an Information Assurance Consultant

Naavi was introduced to the web as a columnist around 1997 and started his web related activities while in service with RKSWAMY/BBDO as an E Commerce Consultant and worked on development of websites to various clients. Subsequently with the release of the draft E Commerce Act 1998, Naavi turned into a Cyber Law Critique and Educationist.

With the release of the book “Cyber Law for Every Netizen in India” in 1999 he became an author.

Organizing the first set of suggestions to the Government on ITA 2000 and passing it onto the Government along with a persistent effort to start a Private Sector CERT, Naavi entered the domain of Netizen Activism.

Early in 2000, Naavi commenced his drive for “Cyber Law Compliance” in industries and pioneered the concept of “Techno Legal Information Security”.

By proposing services such as Lookalikes.in, CEAC.in etc he also fulfilled his role as an entrepreneur in the IT enabled services domain.

With the emerging challenges posed by laws on the information security domain, Naavi pioneered the concept of ITA 2008 compliance audit and also became a leading HIPAA consultant in India. With the stringent prescriptions of RBI on information security in Banks through the GGWG (G Gopalakrishna Working Group) recommendations, Naavi also pioneered the concept of GGWG compliance audits and has changed the perception of Cyber Laws in the industry.

In the recent years Naavi has pioneered a “Three dimensional approach to Information Security” and pioneered concepts such as the “Theory of Information Security Motivation”.

With such a rich background of different facets of operations in business, education and consultancy, in the year 2012, Naavi has redefined himself into an “Information Assurance Consultant” with an integrated approach to Information Security which is inclusive of the three dimensions namely “Technology”, “Cyber Law” and “Behavioural Science”.

Naavi’s innovative approach “Total Information Assurance” for “Modular Implementation” to Information Assurance is likely to contribute a new stream of thought to the domain of Information Assurance Practice. This has also made him the first “Total Information Assurance Consultant” in India.

Since 2005, Naavi is parellelly working on dissemination of Cyber Law Knowledge in Karnataka using Kannada as a language of communication wherever relevant. The development of the Kannada portal on Cyber Law at www.naavika.in will be a significant contributor in this direction. Over a period of time this is also likely to make Bangalore the “Cyber Security Capital” and Karnataka the most Cyber Law aware state in India.

    I would like to know about the situations that may arise when, an employee of a PSU transfers funds from its account maintained with a a bank without the knowledge of his superiors.
    What is the position of the Bank and the customer? (From legal angle)

    Sir,

    My family member got a Vishing call asking to share ATM card details. They didn’t share the details but we have the mobile number from where the call was made. Can you guide us whether we can take any action against him ?

    • You can file a complaint with a)The Police b) The Bank and c) the mobile company. The police can take action to prosecute the person. The mobile company can (should) withdraw the service.The Bank should investigate and find out if any of its staff members are involved and also exercise caution.

    We are a startup in healthcare sector. We deal with patient records. We would like to know if we need to get HIPAA certification. We are currently operating in India only.

    • HIPAA certification is mandatory for organizations who process health care data for US clients. Though you are operating from India you will have obligations as a Business Associate and carry the same obligations. If the patient records are from India, HIPAA Privacy and Security guidelines can be considered a “Recommended Industry Best Practice”. The legal compulsion for security however arises from ITA 2008 which is considered equally stringent as a law though its penal implementation is not as definitive as for HIPAA violations.
