The IT Bill is Ready….For Amendments !
(Note 1)

The IT Bill –99 which came out after a six month long detailed scrutiny by the Parliamentary Standing Committee is now ready for being implemented. Unfortunately, the Bill seems to require several amendments some of which are inevitable even to serve the basic purpose for which the Bill was passed. A quick tour of such required amendments will be presented here.

1.Digital Certificates:
Section Number Action Required Comments
35 (3) Delete This sub section is a drafting mistake. There is no such thing as "Certificate Practice Statement" for applicants of Digital Certificates.

This doesnot belong to the section concerning issue of Digital Certificates to those who apply to the Certifying Authorities. 

It actually belongs to the section relating to Certifying Authorities applying for license with the Controller. 

35 (2) Delete This is also a mistake just as 35 (3)

This also would mean that the statute would determine the pricing of a Certification service which is a private sector domain. 

35 (4) Modify/Edit The first and last paras under the section to be deleted.
