Who is a CyLawCom Examiner?
A person who can undertake CyLawCom Audit in a Company according to the
standards developed by Cyber Law College and assist a Company towards CyLawCom
Certification. [P.S. Same person cannot audit and also prepare a Company for
Certification.]
What is CyLawCom Audit?
Auditing the Manpower, Business Processes, and Strategic Decision making
Processes in a Company and identifying areas of uncovered Cyber Law Related
Risks.
Why Should Any Company Undertake CyLawCom Audit?
Not Checking Cyber Law Compliance in a Corporate environment is like running a
fleet of trucks without ensuring if all Trucks are insured, emission tested,
carrying proper registrations, or if all the drivers are carrying licenses,
are aware of road laws, or if the processes involved in recruitment of
drivers or buying of trucks ensure that proper drivers are recruited and
proper trucks are bought. The non compliance is like carrying a "Floating
Risk" that can any time crystalize into a liability.
How is CyLawCom different from ISO/BS/CMM?Six Sigma?
The focus of CyLawCom is on "Legal Compliance". Other standards focus more on
the technical defect reduction and have a high tolerance of Cyber Law Non
Compliance. A Six Sigma Certified Company without Cyber Law Compliance is like
a Company which engages the services of Michael Schumacher as a driver but not
having a driving license valid in India for the category of vehicle he is
employed to drive. Hence CyLawCom certification is complementary to other
standards.
What is the Scope of CyLawCom Certification ?
CyLawCom Certification addresses possibilities of imperfect Contract
formation, warranties creation, Violation of Privacy Laws, Violation of Anti
Spam Laws,. Violation of Information Technology Act 2000, Violation of
Trademark, Copyright and Patent Laws etc.
What is the Profile of a CyLawCom Examiner?
A CyLawCom Examiner is a "Techno Legal Expert". He knows what are the Cyber
Laws affecting the Operations of a Company and also knows what is a Firewall,
IDS, Disaster Recovery, BCP, Software Development Process, Quality testing of
Software etc.
What are the Qualifications Leading to being a CyLawCom Examiner?
A Technology person with knowledge of Network security with either an
Engineering qualification or MSc IT or MCA type of qualification along with a
Post Graduate Diploma in Cyber Law from a suitable organization with
appropriate training in System Security Audit. CISA qualified Chartered
Accountant with a Diploma in Cyber Law are also well suited for the
requirements. Company secretaries with legal background with additional IT
training and knowledge can also suit the requirements. Lawyers who are
conversant with Cyber Laws and also with Technology can develop into CyLawCom
examiners.
How To Get Recognized as a CyLawCom Examiner?
Irrespective of any prior qualification, any person interested in being a
CyLawCom examiner may take the examination. However it is recommended for
Graduates with the necessary qualification.
Is There any Training Prior to the Examination?
At present Cyber Law College will be conducting CyLawCom training to those who
are registered as "Provisional CyLawCom Examiners", in association with e-ISA,
Chennai.
