Another Drafting Error in the Act
.

Even as the ITAct is getting ready for being given effect to, yet another drafting error has come to the notice of the public. Mr Sajay Bhatia the vigilant advocate from Bangalore has pointed out that According to Sec 63 (1)

"...Any contravention under this Chapter may, either before or after the institution of adjudication proceedings, be compounded by the Controller or such other officer as may be specially authorised by him in this behalf or by the adjudicating officer, as the case may be, subject to such conditions as the Controller or such other officer or the adjudicating officer may specify:..."

It is logical to think that "this chapter" was actually meant to be "this Act" since the chapter 10 in which this clause lies talks on the CRAT and CRAC and not on contoventions or penalties.
